1. Introduction

Ai Sale LLC ("we," "us," or "our") provides an AI-powered sales calling and lead engagement platform that helps businesses deploy AI voice agents, manage outbound and inbound calling campaigns, and integrate with customer relationship management ("CRM") and telephony ("VoIP") systems (the "Service").

This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices available to you when you use the Service - whether you are a Customer (a business that uses AI Sales Agent), an End User (an individual on a Customer's team who operates the platform), or a Contact (a lead, prospect, or customer of our Customers who is contacted by an AI Sales Agent voice agent, or who calls into one).

If you are a Contact, please note: AI Sales Agent is typically a data processor acting on behalf of our Customer, who controls what data is collected and how it is used. Questions about a specific call, campaign, or how your information is being used should generally be directed to the business that contacted you. Contact information for the relevant Customer is available upon request.

2. Information We Collect

2.1 Information Customers Provide to Us

  • Account and billing information (name, business name, email, phone number, payment details)
  • Lead and contact data imported via CRM integration, CSV upload, or manual entry (names, phone numbers, email addresses, company details, and any custom fields the Customer configures)
  • Campaign configuration data (agent personas, scripts, qualification criteria, business rules)
  • Integration credentials/tokens for connected CRM and VoIP platforms.

2.2 Information Collected During Calls

  • Call metadata: phone numbers, call duration, timestamps, call outcome/disposition
  • Call recordings, where enabled and where legally permitted (see Section 8 on Call Recording & Consent)
  • Transcripts generated from call audio via automated speech-to-text processing
  • Derived data: AI-generated summaries, sentiment/qualification scores, and compliance flags produced from call content

2.3 Information Collected Automatically

  • Device and usage data when Customers or End Users access our dashboard (IP address, browser type, pages viewed, session duration)
  • Cookies and similar technologies (see Section 9)

2.4 Information From Third Parties

  • Data synced from connected CRM or VoIP platforms that the Customer has authorized us to access
  • Data from our payment processor, cloud hosting provider, and analytics providers.

3. How We Use Information

We use the information described above to:

  • Operate, maintain, and improve the Service
  • Deploy and run AI voice agents on behalf of Customers, including placing/receiving calls, engaging in conversation, and qualifying leads
  • Generate transcripts, summaries, sentiment analysis, and compliance flags from call content
  • Sync call outcomes and lead status back to a Customer's connected CRM
  • Provide analytics, dashboards, and reporting to Customers
  • Process payments and manage accounts
  • Detect, prevent, and investigate fraud, abuse, or violations of our Terms of Service
  • Comply with legal obligations, including telemarketing and call-recording laws.

We do not sell personal information for cross-context behavioral advertising purposes.

4. Legal Basis for Processing

Where GDPR or similar law applies, we (or our Customers, as data controller) rely on the following legal bases:

  • Contractual necessity - to provide the Service to Customers
  • Legitimate interests - to improve the Service, ensure security, and prevent fraud
  • Consent - where required, e.g., for call recording in jurisdictions requiring it
  • Legal obligation - where processing is required by law

5. How We Share Information

We share information with:

  • Connected CRM and VoIP providers the Customer has authorized (e.g., syncing a call summary to Salesforce or HubSpot)
  • Sub-processors and service providers who support our infrastructure (e.g., cloud hosting, speech-to-text/AI model providers, payment processors).
  • Affiliates, for internal business operations.
  • Legal and regulatory authorities, where required by law, subpoena, or to protect the rights, safety, or property of AI Sales Agent, our Customers, or others
  • A successor entity, in the event of a merger, acquisition, or sale of assets

We do not share Contact data with unrelated third parties for their own independent marketing purposes.

6. Data Retention

  • Customer account data is retained for as long as the account is active, plus 60 after termination for legal/billing purposes.
  • Call recordings and transcripts are retained for 30 days period, or "as configured by the Customer”, after which they are deleted or anonymized.
  • Customers can typically configure retention settings and request deletion of Contact data through their dashboard or by contacting support@aisaleagent.com.

7. Your Rights and Choices

Depending on your location and role, you may have the right to:

  • Access, correct, or delete personal information we hold about you
  • Object to or restrict certain processing
  • Request a copy of your data in a portable format
  • Opt out of the "sharing" of personal information (we do not currently sell/share personal information as defined under CCPA/CPRA)
  • Withdraw consent, where processing is based on consent (e.g., call recording, where applicable)

If you are a Contact (someone contacted through the Service), please direct requests to the business that used AI Sale Agent to contact you, as they generally control the data. If you're unable to identify that business, contact us at support@aisaleagent.com and we will assist in routing your request.

California residents: You have rights under the CCPA/CPRA, including the right to know, delete, correct, and opt out of sale/sharing of personal information, and the right to non-discrimination for exercising these rights. Reach us out at support@aisaleagent.com

EU/UK residents: Where GDPR/UK GDPR applies, you have the rights described above and the right to lodge a complaint with your local data protection authority.

8. Call Recording, Consent & Telemarketing Compliance

  • Where a call is recorded, we (or our Customer) will disclose this consistent with applicable law, including one-party and two-party/all-party consent state laws in the U.S. (e.g., California, Florida, and other "two-party consent" states require all participants to consent to recording).
  • Customers are solely responsible for ensuring their use of the Service - including calling lists, scripts, calling hours, and Do-Not-Call list compliance - complies with the Telephone Consumer Protection Act (TCPA), Telemarketing Sales Rule (TSR), state-level telemarketing laws, and any applicable Do-Not-Call registries.

9. Cookies and Tracking Technologies

We use cookies and similar technologies on our website and dashboard to:

  • Keep you logged in and remember preferences
  • Understand usage patterns and improve the Service
  • measure marketing campaign performance

10. Data Security

We use administrative, technical, and physical safeguards designed to protect information from unauthorized access, disclosure, alteration, or destruction, including encryption of data in transit and at rest, access controls, and monitoring.

No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

11. International Data Transfers

If we transfer personal information across borders (e.g., from the EU/UK to the U.S.), we rely on appropriate safeguards such as Standard Contractual Clauses or equivalent mechanisms.

12. Children's Privacy

The Service is not directed to individuals under 18, and we do not knowingly collect personal information from children. If we learn we have inadvertently collected such information, we will delete it.

13. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be notified via dashboard notice and/or website banner, and the "Last Updated" date above will reflect the most recent revision.
